01 //OVERVIEW & ACCEPTANCE

These Terms and Conditions (“Terms”) govern your access to and use of the website located at gojestreetwear.ca (the “Site”), operated by GOJÉ Streetwear (“GOJÉ”, “we”, “us”, or “our”), headquartered in Thornhill, Ontario, Canada.

By accessing, browsing, creating an account, or purchasing merchandise from GOJÉ, you agree to be legally bound by these Terms and our related policies. If you do not agree with any part of these Terms, you must discontinue using our services immediately.

02 //CANADIAN JURISDICTION & GOVERNING LAW

These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

You agree that any legal action, dispute, or proceeding arising out of or relating to your use of this Site or transactions conducted through it shall be instituted exclusively in the provincial or federal courts situated in Toronto, Ontario, Canada.

03 //CURRENCY & CANADIAN SALES TAX (GST / HST / PST)

Unless explicitly indicated otherwise, all prices displayed on our website are denominated in Canadian Dollars (CAD).

In accordance with Canadian taxation legislation, applicable sales taxes are calculated and charged based on the destination delivery address provided during checkout:

• Ontario: 13% Harmonized Sales Tax (HST)
• British Columbia: 5% GST + 7% PST
• Quebec: 5% GST + 9.975% QST
• Alberta, Northwest Territories, Nunavut, Yukon: 5% GST
• New Brunswick, Newfoundland and Labrador, Nova Scotia, Prince Edward Island: 15% HST
• Manitoba, Saskatchewan: 5% GST + Provincial Sales Taxes

04 //LIMITED EDITIONS, ORDER ACCEPTANCE & PRICING ERRORS

Due to our limited batch production models and exclusive atelier mechanics, items in your cart are not reserved until checkout payment is completed and verified. We reserve the right to limit quantities purchased per customer, per household, or per order.

Receipt of an electronic order confirmation does not constitute our acceptance of an order or confirmation of an offer to sell. In the rare event of a typographical error regarding pricing or inventory availability, GOJÉ reserves the right to cancel any impacted order and promptly issue a full refund to your original payment method in compliance with the Ontario Consumer Protection Act.

05 //CANADIAN ANTI-SPAM LEGISLATION (CASL) COMPLIANCE

GOJÉ strictly adheres to Canada’s Anti-Spam Legislation (CASL). We will never send you Commercial Electronic Messages (CEMs) such as newsletters, collection announcements, or promotional campaigns without your express, verifiable opt-in consent.

You maintain the absolute right to withdraw your consent and unsubscribe at any time using the one-click unsubscribe mechanism present in every communication or by contacting our privacy desk. Transactional emails (such as order invoices and shipping tracking links) will continue as necessary for service fulfillment.

06 //INTELLECTUAL PROPERTY & TRADEMARKS

All content on this Site—including but not limited to brand graphics, garment cuts, architectural photography, typography, logos, and custom code—is the proprietary intellectual property of GOJÉ Streetwear and is protected by Canadian and international copyright and trademark laws.

No content may be reproduced, modified, republished, or commercially exploited without prior written authorization from GOJÉ.

07 //LIMITATION OF LIABILITY

To the maximum extent permitted by applicable Canadian law, GOJÉ Streetwear, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the website or purchased goods.

Nothing in these Terms excludes or limits any statutory consumer rights that cannot be waived under Ontario or Canadian provincial consumer protection legislation.
